Terms and Conditions for Lifetime Chapters Photography

1. Introduction

By booking or purchasing any services provided by Lifetime Chapters Photography, you (the “Client”) agree to be bound by these terms and conditions. These terms govern all photography services provided and outline the use of photographs for marketing purposes.

2. Booking and Payment

2.1. A non-refundable booking fee of [amount] is required to secure your session date and time. This fee is applied to your final balance.
2.2. Full payment is required before the scheduled session or as per the agreed payment plan. Failure to make full payment may result in the cancellation of your session.
2.3. Rescheduling is permitted with a minimum of 7 days' notice, subject to availability.

3. Cancellations and Refunds

3.1. The booking fee is non-refundable except as required by Australian Consumer Law (e.g., for services not provided).
3.2. Cancellations with less than 48 hours’ notice may incur additional fees.

4. Photography Session

4.1. The Client agrees to arrive on time for their session. Late arrivals may result in reduced shooting time without refund.
4.2. The photographer reserves the right to terminate the session if the Client behaves inappropriately or violates any agreed-upon terms.

5. Photo Delivery

5.1. Edited photographs will be delivered digitally or in physical format as per the package selected. Delivery timelines will be communicated at the time of booking.
5.2. The Client may not alter or edit photographs (e.g., adding filters or adjustments) without the photographer’s written consent.
5.3. Lifetime Chapters Photography retains the right to refuse further editing requests outside of the agreed-upon scope.

6. Copyright and Usage of Photographs

6.1. All photographs remain the copyright of Lifetime Chapters Photography.
6.2. By booking a session, the Client grants Lifetime Chapters Photography the right to use images from the session for promotional and marketing purposes, including but not limited to:

  • Social media platforms
  • Website galleries
  • Print or online advertisements
  • 6.3. If the Client does not wish their images to be used for promotional purposes, they must inform the photographer in writing before the session.
  • 6.4. The Client is granted a limited license to use photographs for personal purposes only. Commercial use of the photographs by the Client is prohibited unless expressly agreed in writing.


7. Liability

7.1. Lifetime Chapters Photography will take all reasonable precautions to ensure the safety and quality of the services provided.
7.2. In the event of unforeseen circumstances (e.g., illness, equipment failure), the photographer reserves the right to reschedule the session or provide a replacement photographer.
7.3. To the fullest extent permitted by law, Lifetime Chapters Photography is not liable for any loss, damage, or injury sustained during the session or arising from the use of the photographs.

8. Privacy

8.1. Personal information provided by the Client will be used solely for the purpose of delivering photography services and will not be shared with third parties without consent, except as required by law.

9. Dispute Resolution

9.1. Any disputes arising out of or in connection with these terms shall first be attempted to be resolved through good faith negotiation.
9.2. If the dispute cannot be resolved, it will be submitted to mediation before proceeding to litigation in accordance with the laws of Victoria, Australia.

10. Governing Law

10.1. These terms and conditions are governed by the laws of the State of Victoria, Australia. Any legal claims will be handled in Victoria.

11. Amendments

11.1. Lifetime Chapters Photography reserves the right to amend these terms and conditions at any time. 12. Photography Style and Artistic Discretion

12.1. By booking with Lifetime Chapters Photography, the Client acknowledges that they have reviewed the photographer’s portfolio and understand the specific style of photography and editing provided.
12.2. The Client agrees to allow the photographer full artistic discretion in capturing and editing the photographs in line with this established style.

12.3. Requests for significant deviations from the photographer’s style may not be accommodated.
